This monthly newsletter is shared with the broader outdoor industry, members and non-members of Outdoor NSW & ACT in the Outdoor Industry. To receive more regular and informative news, become a member today.

From the CEO's Desk

It’s been a month of ups and downs for the team at Outdoors NSW & ACT as we continue to drive forward on multiple fronts.

 

One of the most urgent matters we've had to respond to is a piece of legislation that was confirmed to take effect 1 August, without industry consultation, and will have serious impacts on many of our members—particularly small and medium businesses involved in e-bike use and hire.

 

We quickly mobilised, engaging with policymakers to highlight the unintended consequences of this bill and advocated for amendments that would protect the viability of outdoor recreation, and tourism organisations. The speed and weight of our response reflects just how vital it is to have a united voice representing our industry. We hope that we have some success in its delayed implementation if not some better consideration behind e-bike certification. 

 

At the same time, our team has been working tirelessly behind the scenes to bring the 2025 Outdoor Industry Summit to life. With just days to go, we’re excited to welcome attendees from all corners of the industry to Canberra.

 

The program has been carefully curated to tackle the real issues facing us right now—workforce shortages, regulatory change, efficiency in business, and the rise of AI and climate risk.

 

It's more than an event—it's a chance to connect, collaborate, and forge a stronger future for our sector. I look forward to seeing you all there.

🚳 E-Bike Legislation in NSW

As of 1 August 2025, the NSW Fair Trading Information Standard for e-micromobility products becomes fully enforceable. This regulation introduces mandatory requirements for businesses involved in the sale, hire, or supply of lithium-ion battery-powered e-micromobility devices, such as e-bikes, e-scooters, e-skateboards, and hoverboards. Giving less than 6 weeks notice!

 

Key Requirements for Businesses

1. Provision of Safety Information at Point of Sale or Supply:

  • Businesses must provide consumers with clear and accurate safety information at the time of sale or supply. This includes guidance on:

    • Safe use and charging practices

    • Proper storage methods

    • Fire prevention measures

    • Disposal procedures for devices and batteries

2. Display of Usage Law Advisory:

  • Suppliers are required to prominently display the following statement on their website and on or near the e-micromobility devices:

    "Before using this vehicle, check the applicable local laws relating to your intended use of the vehicle on roads and road related areas."

3. Compliance with Product Safety Standards:

  • E-micromobility devices and their lithium-ion batteries are classified as "declared electrical articles" under the Gas and Electricity (Consumer Safety) Act 2017. This classification mandates that these products meet prescribed safety standards before they can be sold OR hired in NSW. From 1 August 2025, enforcement of these standards will commence, and non-compliance may result in penalties. 

  • Currently, there are no e-bikes in Australia that comply with this classification! Owners must seek manufacturer re-certification to meet these requirements.

Penalties for Non-Compliance

  • Failure to adhere to the Information Standard can result in fines of up to $5,500 per breach.

  • Non-compliance with the Product Safety Standards may attract penalties of up to $825,000.

Outdoors NSW & ACT together with Bicycle Industries Australia are advocating on behalf of the industry to delay this legislation or consider its practical implementation from what are small businesses and not for profit organisations involved in e-bike hire. 

📅 What Changes from 1 July 2025

CHANGES THAT COMMENCE 1 JULY!

💰 Financial & Taxation Changes

  • Minimum Wage Increase: The national minimum wage has risen by 3.5% to $24.95 per hour or $948 per week. This adjustment affects all employees not covered by an award and awards that use the minimum wage.

  • Superannuation Guarantee Rate: Employers are now required to contribute 12% to their employees' superannuation, up from 11.5%. This applies to all salary and wages paid on or after 1 July 2025.

  • ATO Interest Deductibility: Interest charged by the Australian Taxation Office (ATO) on overdue tax debts is no longer tax-deductible. This change increases the cost of carrying tax debt, particularly affecting small businesses.


🏢 Business Operations & Compliance

  • Business Name and Company Fees: The Australian Securities and Investments Commission (ASIC) has increased fees: one-year business name registration now costs $45 (up from $44), and three-year registration is $104 (up from $102). Company registration fees have also risen.


⚡ Energy & Environmental Initiatives

  • Energy Bill Relief for Small Businesses: Eligible small businesses may receive up to $150 in energy bill rebates, automatically applied in two $75 quarterly installments from 1 July 2025 to the end of the year.

👨‍🏫 TAFE's Decision on Roping Units

Continual advocacy is occurring following the written notice from TAFE NSW to permanently remove the roping skill sets from the Outdoor Leadership Course from their scope of delivery.

 

Meeting with Training Services may provide some options for filling our gap in training needs. We continue to work with NSW Government on finding solutions and meanwhile we are providing options through our Professional Development programs for short term needs. 🏞 Risky Play Statement Released

It was great to be present at the release of the "Risky Play Statement" at the Play Australia Conference in Melbourne last week. We all know the value of play for children and taking measured risks in play builds skills that can not be substituted elsewhere. 

 

This Position Statement challenges the current Australian narrative around risky play and highlights a benefit-risk approach to risky play for all young children.

The Position Statement recognises the importance of risky play for all children’s health and well-being. However, the Position Statement intentionally focuses on children aged birth to 8 years.

🌿 OCA Strategy Released

The Outdoor Council of Australia (OCA) has launched its Strategic Plan, outlining a five-year vision to strengthen the nation's outdoor industry.

Unveiled at the OCA Member Forum on 19 June, the plan emphasises responsible access, safety, inclusivity, and a unified national voice. Key initiatives include the national Outdoor Census, the next stage of the Australian Adventure Activity Standards once they are reviewed, and collaborative advocacy efforts. The plan aims to provide tools and resources that will empower the industry to support all individuals of all backgrounds to connect with nature and each other.

🚵‍♂️ MTB Symposium Legacy to be released at the Summit

In October 2024, ONSWACT held the MTB Symposium in the beautiful town of Merimbula NSW. This event brought together 134 stakeholders from across the MTB sector to talk about the challenges and opportunities that could path the way of the future of MTB in NSW & the ACT. The discussions were recorded and culminated in the MTB Manifesto.

 

This document was shared with key stakeholders in June and will be released to the industry at the Outdoor Industry Summit in July.

Released in April, the ONSWACT Cultural Awareness Training Program has had over 30 completions so far.

    From 26 February 2025, eligible casuals can provide written notice to their employer to change to full-time or part-time employment under the new employee choice pathway. An employer can only refuse the notice for certain reasons. We have new templates available to help you meet the new rules.

    Skin Cancer Action for Outdoor Workers

    The CEOs of Office of Sport, Cancer Institute of NSW, Sports Medicine Australia, Cancer Council NSW, Melanoma Institute & ONSWACT have combined forces in a joint letter to bring the Sport & Recreation together on the AIS Sun Safe position. Whilst we may not be able to look at all levels of protection, like elimination of the outdoors, it is important to review your administration, operational and PPE measures to protect your staff and attendees from skin cancer.

    Job Classifications have changed

    ANZSCO, Australian and New Zealand Standard Classification of Occupations, was a joint system used by both Australia and New Zealand to categorise occupations, but it has been replaced by OSCA (Occupation Standard Classification for Australia) as Australia now has its own tailored occupation classification system to better reflect its unique labor market needs, while maintaining comparability with New Zealand's classification. A majority of our workforce will now fit under one area - 4624 Sports Coaches and Outdoor Adventure Guides thanks to the advocacy that took place in 2023-2024.

    Outdoor worker risks- JEV

    Japanese encephalitis is a rare but serious illness caused by the Japanese encephalitis virus (JEV). It is spread to humans by infected mosquitoes.

     

    In NSW, a free Japanese encephalitis virus vaccination is available for people aged 2 months or older who regularly spend time outdoors placing them at risk of mosquito bites.

    Pinnacle Leaders Graduate

    25 Women from the Outdoor Industry will graduate from the very first Pinnacle Leadership Program in July at the Outdoor Industry Summit. This program has been a great journey for the participants and their mentors. Each has taken something different from the program and we look forward to analysing their journey so that we can fine tune the program for future cohorts.
